1. Our commercial policy

1.1 The Seller offers for sale on www.francescobarbato.com products and carries out electronic commerce activities exclusively towards consumer end-users.

1.2 "Consumer" is the natural person who purchases one or more products through the online store for purposes not related to his or her commercial or professional activity, accepting these General Conditions. 1.3 The Seller reserves the right not to process orders from parties other than the consumer and/or not in accordance with these General Terms and Conditions of Sale.

2. Conclusion of the contract

2.1 To purchase one or more products on www.francescobarbato.com, complete the order form electronically and send it to the Seller following the on-screen instructions.

2.2 The order form contains essential information on products, prices (including taxes), payment and delivery methods, shipping costs, conditions for exercising the right of withdrawal and terms/manner of return.

2.3 The contract is concluded upon receipt by the Seller of the order form transmitted telematically, after verification of the correctness of the data.

2.6 The Seller may not process orders that do not offer sufficient guarantees of solvency, are incomplete/unfinished or in case of unavailability of products. In this case you will be informed by e-mail. If the products are no longer available at the time of the order, the Seller will notify you within thirty (30) days of receipt of the order; in case of payment already made, a refund of the amounts paid will be arranged.

2.7 Sending the order form implies unconditional acceptance of these General Terms and Conditions of Sale.

2.8 By sending the order form, you confirm that you also know and accept the additional information on www.francescobarbato.com (Terms of Use, Privacy Policy, Right of Withdrawal Policy).

2.9 Once the contract is concluded, you will receive an order receipt by e-mail with a summary of the essential information.

3. Product warranties and prices

3.1 The essential features of the products are presented on www.francescobarbato.com in the relevant tabs. The images/colors may differ from the actual ones depending on the browser and monitor used.

3.2 The Seller does not sell used, irregular or substandard products.

3.3 In case of withdrawal, the Seller may refuse returns of products altered in essential/quality characteristics or damaged.

3.4 Prices may vary: always check the final price before sending your order.

3.5 Purchase requests from countries not listed on the country choice page cannot be accepted.

4. Payments

4.1 The prices indicated are VAT included and include packaging/packaging.

4.2 The available payment methods are indicated in the order form.

4.3 In case of payment by payment card, the financial data (card number, expiry date, etc.) are transmitted via encrypted protocol to the institutions providing remote payment services, without access by third parties or the Seller. This data will only be used to complete the purchase, handle any refunds or prevent/discover fraud. The price and shipping charges will be charged when the purchased products are shipped.

5. Shipping and Delivery

7. Right of Withdrawal

7.1 You have the right to withdraw from the contract concluded with the Seller, without penalty, according to the terms and procedures set out in the Right of Withdrawal section below and/or in the instructions on the site.

7.2 To exercise the right of withdrawal, you must indicate the products purchased, the order number and your identification data for the purpose of reimbursement. The products must be returned to the Vendor within the time limits set out in 7.4.

7.3 You are responsible for the shipping costs for the return.

7.4 Conditions for withdrawal: - correctly completed waybill; - undamaged products at the time of return, unused, unmodified, undamaged; - return in a single shipment, in the original packaging complete with identification tag; - receipt of the returned products by the Vendor within the authorized time limits.

7.5 If the withdrawal is properly exercised, the Seller will refund the amounts collected for the purchase within 30 days from the date it became aware of the withdrawal.

7.6 If the terms and conditions are not met, you will not be entitled to a refund. You will, however, be able to re-obtain, at your expense, the products in the state in which they were returned; otherwise, the Seller may retain them in addition to the sums already paid.

7.7 The return of customized products (with name/logo or made to customer specifications) is not permitted.

8. Timing and method of reimbursement

8.1 Following the return, the Seller will check whether the products comply with the conditions set out in §7. If positive, it will send confirmation by e-mail and activate the refund procedure as soon as possible and in any case within 30 days from the date on which it became aware of the exercise of withdrawal.

8.2 The actual time of re-credit depends on the payment instrument used (for cards, generally within two statements). The value date of the re-credit coincides with the debit date.

10. Applicable Law and Disputes

10.1 These General Terms and Conditions of Sale are governed by Italian law, in particular by Legislative Decree No. 206 of September 6, 2005 (Consumer Code) and Legislative Decree No. 70 of April 9, 2003 (e-commerce).

11. Amendments and Updates

11.1 The General Terms and Conditions of Sale may be amended for regulatory or organizational adjustments. The new conditions are effective from publication on www.francescobarbato.com.

Right of Withdrawal

If you are not satisfied with your purchase, you may exercise your right of withdrawal within fourteen (14) days of receipt of the products purchased on www.francescobarbato.com, without penalty, by following the procedure indicated on the website and sending a return request by e-mail to info@francescobarbato.com. The return must be authorized before the package is shipped. You can request size exchange or exchange for another product, subject to availability.

Conditions for the exercise of withdrawal

- return request via e-mail to info@francescobarbato.com within 14 days of receipt;

- unused, unmodified, undamaged products;

- products in the original packaging complete with identification tag;

- delivery of products to the shipper within 14 days of receipt;

- return costs to be borne by the customer; customer's responsibility for loss/damage in transit.

Exclusions: personalized products (name/logo or customer specifications) cannot be returned.

Refund

Once the products have been received and checked for conformity, the Seller will send confirmation via e-mail and activate the refund as soon as possible, however, within 30 days from the date it became aware of the exercise of withdrawal. The re-credit time depends on the payment method used.
